Terms of Service

Thank you for choosing Lace Stewart Photography for your photography needs. By booking a session through our website, you agree to the following terms and conditions:

**Booking and Payment:**
- Booking: Sessions can be booked through my website booking link or by contacting me directly.
- Payment: Retainer fee for sessions is due at the time of booking unless otherwise agreed upon. I accept payment through Venmo or Zelle.

**No Cancellation and Retainer Fee Policy:**

Once a session is booked and a retainer fee is paid, clients agree to the following policy:

- No Cancellation: Clients acknowledge that once a session is booked and confirmed, no cancellations will be accepted.
  
- Retainer Fee: A non-refundable retainer fee is required to secure the session date and time. This retainer fee is [insert amount] and is deducted from the total session fee. The retainer fee ensures that the photographer reserves the agreed-upon date and time exclusively for the client and prevents the photographer from booking other clients during that time slot.

- Retainer Fee Non-Refundable: Clients understand and agree that the retainer fee is non-refundable under any circumstances, including but not limited to cancellation, rescheduling, or no-shows.

- Session Rescheduling: In the event that the client wishes to reschedule the session, they may do so based on the availability of the photographer. However, the retainer fee remains non-refundable, and clients are required to pay an additional retainer fee for the rescheduled session if applicable.

By booking a session and paying the retainer fee, clients acknowledge that they have read, understood, and agree to abide by the no-cancellation and retainer fee policy outlined above.

**Photography Ownership and Usage:**
- Ownership: Lace Stewart Photography retains all rights to the photographs taken during the session, including copyright ownership.
- Usage: Clients are granted a non-exclusive, non-transferable license to use the photographs for personal use only, including printing, sharing on social media, and personal websites. Commercial use of the photographs is prohibited without prior written consent from Lace Stewart Photography.

**Model Release:**
- By participating in the session, clients grant Lace Stewart Photography the irrevocable and unrestricted right to use and publish photographs of the clients for editorial, advertising, and promotional purposes.

**Liability:**
- Lace Stewart Photography is not liable for any injury, loss, damage, or theft that may occur during the session or on the session premises.
- Clients are responsible for the behavior and safety of all individuals participating in the session, including children and pets.

**Governing Law:**
- These terms and conditions shall be governed by and construed in accordance with the laws of the State of Alabama.

**Changes to Terms:**
- Lace Stewart Photography reserves the right to modify or update these terms and conditions at any time. Clients will be notified of any changes.

By booking a session with Lace Stewart Photography, you acknowledge that you have read, understood, and agree to these terms and conditions.
